Operational Status & Oversight

The Flamingo Heights Community Center is currently operated under the fiscal sponsorship of kulturspace nonprofit limited AKA The kulturspace Foundation, a registered 501(c)(3) nonprofit organization in good standing with both the IRS and the State of California. Through this structure, all programs, events, and community services at the center are conducted legally and with full insurance, financial oversight, and charitable compliance.

About Fiscal Sponsorship

Fiscal sponsorship is a formal legal arrangement that allows a charitable project like the Flamingo Heights Community Center to operate under the umbrella of a fully compliant nonprofit. The kulturspace Foundation provides financial management, liability coverage, and ensures that all activities align with its exempt purpose. This structure enables continuity of services to the community while maintaining strict adherence to nonprofit law.

A formal Fiscal Sponsorship Agreement, effective January 30, 2025, is in place between The kulturspace Foundation and the Flamingo Heights Community Association (FHCA). Under this agreement, The kulturspace Foundation receives, manages, and disburses funds related to FHCA’s activities, with full legal and financial responsibility. A dedicated bank account has been established, all expenditures are subject to nonprofit compliance standards, and neither organization collects any fees or commissions. This sponsorship is a public service, and no individuals receive compensation for their involvement.

Advisory Leadership Structure

The current board members of the Flamingo Heights Community Center serve as community advisors under the fiscal sponsorship of The kulturspace Foundation. While they help guide local programming and community engagement efforts, all legal, financial, and governance authority rests solely with The kulturspace Foundation.

Although some individuals serve in roles within FHCA and The kulturspace Foundation, strict separation of duties is maintained to ensure compliance with nonprofit regulations. All decision-making authority, contracts, and fiduciary responsibilities remain under the sole jurisdiction of The kulturspace Foundation.

Flamingo Heights Community Association (FHCA) Status

The original nonprofit, Flamingo Heights Community Association (FHCA), is currently listed as suspended by the California Attorney General’s Registry of Charitable Trusts due to past nonreporting by former board officers. Significantly, this suspension affects only FHCA's ability to operate independently as a nonprofit and does not impact the day-to-day operations of the community center, which are fully managed under The kulturspace Foundation.

Proactive steps have been taken to resolve this issue. All past-due filings are being submitted to both the California Department of Justice and the IRS, intending to restore FHCA’s legal standing and preserve its historic nonprofit status for future use.

Compliance & Transparency

  • All donations are collected and managed through The kulturspace Foundation and are tax-deductible as permitted by law.

  • All insurance, contracts, and public activities are conducted solely under the authority of The kulturspace Foundation.

  • FHCA funds are held in a dedicated bank account and managed with regular financial reporting.

  • The center operates fully independently from any legal or financial obligations tied to the suspended FHCA.
